What is considered an incapacitated adult?
According to the U.S. Department of Justice, a court may find that a person needs a guardian because they are not able to make critical decisions about their personal and/or financial affairs on their own. This legal finding is the process used to determine what is considered an incapacitated adult, requiring court intervention to protect the individual's or their resources from substantial harm. The criteria are based on medical evidence, not just poor judgment.
